I have been looking through the official wording of the Declaration of Human Rights, and I want to point out some of our basic human rights that are still being violated today in this country, but first I will post this infographic to help explain the Declaration of Human Rights in a more easy to read language. I just want to thank zenpencils.com for providing this.
First stop the Preamble of the Declaration of Human Rights:
“Recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world… It is essential, if man is not to be compelled to have recourse,as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law”
The War against Terrorism, a classic example of the violation of the declaration of human rights. You can argue that the terrorists are violating our rights, or you can argue that our allies are violating the rights of ‘suspected terrorists’.
“All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.”
“Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty”.
Racism, Sexism and Discrimination against Religions (Bigotry) are all violations of the basic human rights. Australia when you offer the Aboriginal and/or Torres Strait Islanders extra benefits because of, and purely based on, the fact that they have Aboriginal or Torres Strait Islander Genes, you are not considering them equal! Therefore you are violating the basic human rights of all parties involved.
“Everyone has the right to life, liberty and security of person”.
Guess what that means, all criminals are violating our human right to life, liberty and security. The fact that in some countries an intruder can sue the victim because they hurt themselves intruding the victims house, car, etc… Violation of the victims human right to life, liberty and security. The death penalty… A violation of the criminals human right to life, liberty and security. “Stopping the Boats” A violation of the boat people’s human right to life, liberty and security.
“No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment”.
Guantanamo Bay anyone? Huge violations there, and that’s just the ones we know about. Reading over that again I’ve noticed that some Prisons and most “Detention Centres” will also be violating human rights.
There should be no such thing as “Legal Torture,” Torture is torture. End of story.
“Everyone has the right to recognition everywhere as a person before the law”.
“All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination”.
So my question to you is: if you are a lawyer, and you charge more because you are a good lawyer, does that not mean you are violating the human rights of those that can’t afford you because you will not protect, and therefore are discriminating against, those with shallower pockets?
Those new Bikie Laws they are trying to impose in QLD Australia, where the bikies will get longer sentences for their crimes purely because they are bikies… Violation of the Bikies Human rights to equal protection against any discrimination. That law where they are trying to make it illegal for bikies to own Tattoo shops, violation of the human right to equal protection against discrimination, and violation of the right to own property… But wait, what about all those banks who will not lend out to people who want to buy property, is that a violation of the human right to own property?
“No one shall be subjected to arbitrary arrest, detention or exile”.
Ok, so there’s Guantanamo Bay, Nairut, PNG, Manus Island; they even call them “Detention Centres” They have made it blatantly obvious that these are a violation of human rights. So why is it that nobody is doing anything about it?
Australia, you signed the Declaration, ignorance is not an excuse. Oh yeah, and then there’s Julian Asange, forced to seek Asylum in the Ecuadorian embassy because if he steps foot outside of it he will be exiled and eventually charged for treason. WTF? How can the americans charge him for treason when he is an AUSTRALIAN citizen, not an american citizen? How do we let them get away with this?
“Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him”.
Again Julian Asange, a victim of a violation of this right as well.
“(1) Everyone charged with a penal offence has the right to be presumed innocent until proven guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
(2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed”.
The new Bikie laws they are trying to impose in QLD Australia. A violation of the above human right.
“No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks”.
Americas anti-terrorism measures, Rupert Murdoch, every political campaign ever, every bully, pretty much every gossip magazine ever invented. All Violations of the above basic human right.
“(1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.
(2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations.”
By not allowing Asylum seekers to seek asylum in our country, especially when we know it is due to political unrest in their own country, is a violation of the above human right.
“(1) Everyone has the right to a nationality.
(2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality”.
Disallowing dual citizenship is a violation of the above human right, removing citizenship without reason is a violation of human rights.
“(1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.
(2) Marriage shall be entered into only with the free and full consent of the intending spouses.
(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State”.
Disallowing Marriage Equality and same sex marriage is a violation of the above Human Rights, arranged marriage, unless they are both Adults, and is fully and freely consented by both parties, is a violation of human rights. As is not offering support from the government to those in need… American Republicans, by stopping Obamacare you are violating every American’s human right to protection by the state from ill health.
“Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers”.
Internet Filters, Media Blackouts etc. are a violation of human rights, Americas Anti-Terrorism measures are a violation of human rights, Julian Asange is also a victim of the violation of this human right.
“(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.
(2) Everyone has the right of equal access to public service in his country.
(3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures”.
Dictatorships and Monarchs, unless they have a public representative in government is a violation of human rights. Voting is not a privilege, it is a right, so please make it count. Obamacare was voted in by the American public, by stopping or reducing the access to Obamacare, you are violating human rights
“(1) Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
(3) Everyone who works has the right to just and favourable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.
(4) Everyone has the right to form and to join trade unions for the protection of his interests”.
Sweat shops are a violation of human rights, but everyone already knew that. So is any law reducing the protective quality of Trade Unions, Australia I’m looking at you, it’s already been done before, then removed, don’t try it again. It could be argued that Casual work will also fall into this category as there is no protection against unemployment.
“Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay”.
Did you see that… Reasonable work hours and PERIODIC HOLIDAYS WITH PAY, it is a violation of human rights to have Casual employment where there are no paid holidays, no protection against unemployment, and no limitation on the length of the work day. It is also a violation of human rights to stop an employee from taking a holiday for no good reason.
“(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.
(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection”.
I’m looking at you again America and the current Liberal Government of Australia. It’s a violation of human rights to not offer a pension where a human being can live a dignified life, if they are no longer employed due to disability, old age or illness.
“(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.
(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace.
(3) Parents have a prior right to choose the kind of education that shall be given to their children”.
So if education is not offered for free at elementary level it is a violation of human rights, as is making it illegal for a certain religion, sex or race or any other form of discrimination to get educated.
“(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.
(2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author”.
So media piracy is not just against the law, it is also a violation of human rights. And then to all those companies who say that “…by joining our development team, and signing this contract any of your ideas developed here are our ideas and you relinquish all credit to them…” is actually violating the above human right.
“Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized”
“Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein”.
We are all entitled to a social order in which we can receive these rights, so whether it’s law, or religion or culture to violate these human rights, it is still violation of these human rights. It also means any contract which states that by signing this contract you agree to relinquish any (single or otherwise) human rights is a violation against human rights, as is any law that states this, or any organization that states it.
